While we provide best-effort support based on our experience and the information shared by you, we cannot guarantee specific outcomes such as recovery of every account, removal of every impersonation, approval of every request, or particular levels of followers, engagement or revenue.

5. Fees, Payments & Refunds

Service fees, payment schedules and any taxes (such as GST) will be communicated to you before the work begins.

• Fees are generally non-refundable once work has started, except where required by law or specifically agreed in writing.
• Delayed payments may result in pause or termination of services.
• Any additional work outside the agreed scope may be billed separately with your approval.

6. Client Responsibilities

You agree to:

• Provide accurate and truthful information for all services, especially for recovery and impersonation cases.
• Use our deliverables (content, campaigns, strategies) in compliance with applicable laws and platform policies.
• Keep your own account credentials secure and avoid sharing passwords in unsafe ways.

7. Intellectual Property

Unless otherwise agreed in writing:

• All original content, designs, strategies and materials created by Emergina for you remain our intellectual property until full payment is received.
• Upon full payment, you receive a right to use the agreed final deliverables for your business, subject to any third-party licence terms.
• You confirm that any content or materials you provide do not infringe the rights of any third party.

8. Confidentiality

We treat your confidential information with care and will not share it with unauthorised third parties, except:

• Where necessary to deliver the services (for example, with trusted vendors or platform support),
• Where you have given permission, or
• Where required by law or regulatory authorities.

9. Limitation Of Liability

To the maximum extent permitted by law, Emergina shall not be liable for any indirect, incidental, special or consequential loss, or for any loss of profits, revenue, data or goodwill arising out of or related to:

• Your use or inability to use our website or services,
• Decisions made by third-party platforms or service providers, or
• Any unauthorised access to or use of your accounts that occurs beyond our reasonable control.

Where liability cannot be excluded, it will be limited to the amount you have paid to us for the specific service giving rise to the claim.

You agree to indemnify and hold harmless Emergina, its owner and team from any claims, damages or expenses arising out of:

Either party may terminate an ongoing service engagement by giving reasonable notice, subject to any specific terms in the proposal or agreement.

On termination, you agree to pay for all work completed up to the date of termination and any committed third-party costs that cannot be cancelled.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Erode, Tamil Nadu, India, unless otherwise required by applicable law.
